Employers without workers’ compensation insurance can be fined from $100 up to $1,000 per day per employee for every day employers do not have coverage.
If employees are awarded benefits from the Uninsured Employers’ Fund (UEF), employers must reimburse the UEF for the monies paid. Additionally, employers without a workers’ comp policy are not protected by the exclusive remedy provision of workers’ compensation and can be sued by an employee to seek compensation for pain and suffering, punitive damages, and any other relief allowed by law.
