Generally, the statute of limitations in Kentucky is two years after the date of the accident, but if payments of income benefits have been made, the claim must be filed within two years of the suspension of payments; in the case of death, within two years after the death, whether or not a claim has been made by the employee himself or herself for compensation. The statute of limitations for occupational disease claims is three years from the date of last exposure.
