Officers of a corporation may complete a Form 4 and file it with the Kentucky Department of Workers’ Claims (DWC) to exclude themselves. However, it is unlawful for an employer to require an employee to execute a rejection of workers’ compensation as a condition of obtaining or maintaining employment.
If an employee voluntarily completes a Form 4, the individual can be excluded from Part One of the workers’ compensation policy. However, the employee cannot be excluded from Part 2 Employers’ Liability of the policy, therefore, payroll would be included for that employee.
